Lawrence Rosenberg, the lawyer representing Eric Jackson informed WMAR-2 News of the state's decision.

According to Rosenberg, during court, the state asked the judge to postpone the trial. The judge denied the state prosecutor's request and proceeded with jury selection.

Rosenberg says the prosecutor then asked the judge to go get a file. The prosecutor returned to the courtroom an hour later stating they were dismissing charges against Jackson.

Although state prosecutors informed Rosenberg of the dismissal of charges, they told him Jackson would not be released.

The State's Attorney office says they can not comment because the case is an open and pending matter.
